This contract is entered into by the owner of Villa Munay-Ki (“the Owner”) and the holiday maker (“the Hirer”)

TERMS AND CONDITIONS

This contract is entered into by the owner of Villa Munay-Ki (“the Owner”) and the holiday maker (“the Hirer”)

CHECK IN/OUT – Check in is 3pm and check out is 12pm. Early check in and late check out can be guaranteed at the time of booking by making payment of a half day rate otherwise it is subject to availability at the time of arrival or departure.

NUMBER OF GUESTS -The rates quoted are for 10 persons. Additional guests maybe permitted subject to prior agreement with the owner. Extra persons including children are charged at US$50.00 per person. For the security of the villa and future guests, only guests registered at the time of the booking are permitted to stay at the villa or use its facilities. Guests wanting to invite friends during the day should also discuss this before hand and get prior permission (additional fees of US$10 per day per person will apply).  Any evidence of unregistered overnight guests will incur a penalty of US$250.00. per person per night and the amount will be deducted from the deposit.

PAYMENT – A 50% non-refundable deposit is required within 7 days of making the booking. Final payment is due 30 days prior to arrival (or 60 days if the booking includes either Christmas or New Year). All payments must be made in US dollars and must be made by Telegraphic Transfer (“TT”), or paypal.

DAMAGE/SECURITY DEPOSIT – A security deposit of US$1000.00 is required and is paid with the final payment. The deposit will be returned to the Hirer in full within 7-10 days of departure, unless damages or repairs need to be carried out as a result of the Hirer’s occupation of Villa Munay-Ki. In this case, the balance of the deposit will be refunded as soon as the cost of repairing any damage has been determined.

CANCELLATION POLICY – All payments received are non-refundable, unless the Owner can find a replacement booking. If a replacement booking can be found the owner shall refund the booking amount to the Hirer less 20%. Notice of cancellation must be received by the Owner in writing. The Owner will confirm receipt of such notice. Should the owner cancel the booking a full refund will be given.

BOOKING ALTERATIONS – Changes can only be accepted if the booking request is made more than 60 days (90 days for any booking including Christmas or New Year) and is subject to an admin fee of US$500 or one nights stay, whichever is greater. Each change made to a booking after its confirmation shall be at the discretion of the management and any change requests made less than 60 days before arrival will be treated as a cancellation.

BEHAVIOUR AND CONDUCT- The hirer is responsible for the appropriate and lawful behaviour of the guests staying at the Villa. Should any member of the party behave in a manner considered inappropriate, the owner or it’s representative may at their absolute discretion ask the offending guest or guests to vacate the Villa forthwith. The Hirer should note that Villa Munay-Ki is located in a residential area and should the hirer give neighbours cause for complaint the Owner may repossess the property immediately and request the Hirer to leave. In any instance, where the hirer is asked to leave, no refund will be made of any monies paid.

SMOKING – is not permitted inside the villa and will incur a fine of $200. Smoking is permitted outside.

DAMAGE – The Hirer is responsible for leaving Villa Munay-Ki and it’s contents in good, clean, working order. The Hirer will be responsible for compensating the Owner for any damage to Villa Munay-Ki  and it’s contents during occupation. Should the Owner believe the Hirer or anyone in his party to be causing excessive damage to Villa Munay-Ki, the Owner may repossess the property immediately and request the Hirer to leave promptly. In this instance, no refund will be made of any monies paid.

LIABILITY -The Owner does not accept any responsibility or liability for any injury, sickness, loss, damage, additional expense or inconvenience, whether directly or indirectly caused by or resulting from the use, condition or occupancy of any aspect of Villa Munay-Ki, including but not limited to its plumbing, electrical, or structural appointments. The Owner also accepts no liability whatsoever for any personal belongings, whether or not placed in the safes provided, vehicle, and contents of such vehicle of the Hirer, or any member or guest of the Hirer’s party during the occupation of Villa Munay-Ki. It is recommended that all guests have travel insurance.

COMPLAINTS -Should the Hirer believe that he/she has cause for complaint concerning their stay at Villa Munay-Ki, this should be discussed promptly with either the Villa manager or the Owner of Villa Munay-Ki. If the Owner believes the claim has merit then he may, at his discretion, offer a partial refund. No liability of any sort shall arise beyond the refund of monies paid. Any such claims by the Hirer must be made in writing by the Hirer prior to his/her departure from Villa Munay-Ki so that the claim may be fully investigated in a timely manner. Any claims made after the Hirer’s departure date will not be considered.

FOOD AND BEVERAGE – We provide a welcome pack of food and drinks for guests on their arrival. Once finished guests can replenish at their own cost. Guest may request cooking as and when they require with 24 hours notice.  Our housekeeper is able to cook american style breakfast and Thai food only.  For meals EXCEPT breakfast, there is a cooking fee ( for lunch and dinner) as per quoted, but all meals does not include ingredients.  For special menus such as seafood BBQ or fine dining Royal Thai or  Western, where extra staff or expertise is required, there will be additional charges. The staff will do one daily shop, for additional shopping trips, there is a fee, cost is ingredients plus  20% or minimum fee of 100bht per trip.

LINEN – is changed every 3 days to 4 days.

TOWELS – bath towels and pool towels are changed EVERY ALTERNATE day.

AIRCONS – Aircons should be switched off when leaving the rooms. Additional costs may be levied if we feel guests are not complying with this.

SERVICE CHARGE- We do not include a service charge in the rental and therefore tipping is encouraged when good service is provided.

STAFFING- The staff work 9 hours between 9- 5pm. For dinner the staff work up to 8.30pm.  Should you wish additional hours, overtime will be charged at 250 bht per hour per staff.


ACCEPTANCE – Payment of the deposit by the Hirer indicates acceptance of these terms and conditions.
